Description
This book deals with the Crown Employees Collective Bargaining Act and the Public Service Act, the statutes that primarily govern unionized and non-unionized employment and labour relations in the Ontario Public Service and Crown Agencies. The book provides a full review of all sections, and all judicial and arbitral consideration, of both acts. It also discusses the unique treatment of the Crown and its employees in the Public Sector Labour Relations Transition Act and the Employment Standards Act.
About the authors
Tim Hadwen is a retired public servant and labour lawyer. He held a range of senior management positions in the Ontario Ministries of Education, Health, Government Services, and the Attorney General. His public service responsibilities included managing the government’s involvement in broader public sector labour relations. He led the implementation of the School Boards’ Collective Bargaining Act, 2014, the merger of the staff of the Community Care Access Centres with the Local Health Integration Networks, and several compensation restraint initiatives.
Prior to joining government, Tim was General Counsel for the Ontario Public Service Employees Union and Assistant Director, Arbitration at the Ontario Nurses’ Association. Formerly, he was a partner at Cavalluzzo, Hayes and Shilton, a leading union-side labour law firm.
David Strang, BA, LLB, LLM, was called to the Bar in 1981 after articling with the union-side firm of Maclean Chercover. He began his career as Ontario coordinator and counsel with the Upholsterers International Union then moved to the Laborers International Union of America Provincial District Council as counsel and assistant manager. In 1989 he joined the Legal Branch of the Ontario Ministry of Labour. In 1993 he transferred to the Labour Practice Group seconded by the Attorney General to provide advice and represent the Crown in its role as employer of the Ontario Public Service. He has regularly represented the Crown in grievance arbitrations and other labour and employment litigation and negotiations, including those leading to AMAPCEO’s original voluntary recognition agreement and OPSEU’s Appendix 18. He frequently advised on labour and employment issues raised by proposed policy initiatives and was seconded to the Ministry of Education to advise on the development and implementation of the School Boards Collective Bargaining Act. Since retirement in 2016, he has engaged in a part-time labour and employment practice representing Crown agencies in the community health sector.
Leonard Marvy is a solicitor with the Ontario Labour Relations Board.
