The anti-SLAPP legislation, more formally known as section 137.1 of the Courts of Justice Act in Ontario and the Protection of Public Participation Act in British Columbia, is arguably the most influential development in Canadian defamation law in the last fifty years, aside from the advent of the internet.

About the authors
David A. Potts received his BA from Cape Town University, his LLB from Dalhousie and his LLM from Osgoode Law School. He was called to the Ontario Bar in 1979. Since then, he has specialized in libel and slander law and in reputation management for a diverse range of clients. He has served on the Ontario Attorney General’s Advisory Committee on the law of defamation, and is a sought-after speaker and writer (CBC, Forbes, USA Today, the Canadian and International Bar Associations, The Law Society of Upper Canada, and many others). He is co-author of Canadian Libel and Slander Actions (Irwin Law, 2004) with Roger McConchie and Canadian Libel Practice (Butterworths, 1985) with Julian Porter, as well as being a contributor to Cyberlibel in Electronic Commerce — A Practitioner’s Guide (Carswell, 2002)
Erin Stoik, LLB, MA, Hons BA, called to the Bar of Ontario in 2003. Erin has worked with Investigation Counsel PC since its inception in 2007. Her practice has been focused on analytical research and writing in all matters of civil litigation, particularly in the areas of torts and civil procedure.
